Welcome to Desert Radio (www.desertradio.fm). By accessing our website, streaming our broadcast, interacting with our station via SMS or WhatsApp, or participating in any of our competitions and promotions, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. General Website Use

1.1. The content provided on www.desertradio.fm is for general information and entertainment purposes only. We reserve the right to modify or remove content without prior notice.

1.2. We make every reasonable effort to ensure the website and our live stream are available continuously, but we cannot guarantee uninterrupted access and will not be held liable for any downtime due to technical maintenance, server issues, or circumstances beyond our control.

2. Competitions and Promotions (On-Air & “WhatsOn”)

The following rules apply to all competitions run by Desert Radio, including but not limited to On-Air giveaways, “WhatsOn” segments, website entries, SMS, WhatsApp, and social media promotions.

2.1. Best Efforts and Delivery

While every best effort will be made to execute competitions, announce winners, and deliver prizes exactly as scheduled and promoted, Desert Radio does not guarantee that schedules will remain unchanged.

2.2. Right to Alter or Cancel

Desert Radio reserves the right to alter, suspend, delay, or cancel any competition, giveaway, or promotion at any time without prior notice. This includes situations where we are unable to deliver the competition as planned due to:

  • A lack of qualifying entries or insufficient audience participation.
  • Technical malfunctions, broadcast failures, network outages, or loss of connectivity.
  • Sponsor withdrawals or unavailability of the promised prize.
  • Force majeure or any other unforeseen circumstances beyond our reasonable control.

In the event of cancellation, no alternative prizes or compensation will be provided.

2.3. SMS and WhatsApp Entries

Where competitions, shout-outs, or polls require participation via SMS or WhatsApp:

  • Standard mobile network rates and data charges apply unless otherwise stated. Premium rates will be clearly communicated if applicable.
  • Desert Radio is not responsible for any delayed, undelivered, duplicated, or lost SMS or WhatsApp messages resulting from mobile network failures, congestion, or technical faults.
  • The time of receipt logged by Desert Radio’s systems will be treated as the official time of entry, regardless of the time the message was sent from the participant’s device.

2.4. Eligibility

Unless otherwise stated, competitions are open to residents of Namibia. Employees of Desert Radio, their immediate families, advertising agencies, and participating sponsors are not eligible to enter.

2.5. Prizes

Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash. If a winner cannot be contacted within 7 days of the announcement, or fails to claim their prize within the stipulated time, Desert Radio reserves the right to forfeit the prize or select an alternative winner.

2.6. Publicity

By entering a competition, participants consent to the use of their name, voice, and/or image by Desert Radio for promotional purposes without any additional compensation.

3. Intellectual Property

All content on this website, including text, graphics, logos, audio clips, and software, is the property of Desert Radio or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our express written consent.

4. User-Generated Content (Including WhatsApp Voice Notes & SMS)

If you submit any material to the website, our social media platforms, or our dedicated SMS and WhatsApp lines (including text messages, images, video, and WhatsApp voice notes), you grant Desert Radio a non-exclusive, royalty-free, perpetual license to use, reproduce, and broadcast that material live on-air or online.

By sending a voice note or message, you consent to it being played or read on-air. We reserve the right to edit, trim, or remove any content that is deemed offensive, defamatory, or inappropriate before or during broadcast.

5. Limitation of Liability

To the fullest extent permitted by law, Desert Radio, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

  • Your use of or inability to use the website, live stream, or station messaging lines.
  • Your participation in any competition or reliance on any “WhatsOn” event listings, which are subject to change by third-party organizers.
  • Any errors, omissions, or inaccuracies in the content provided on the site or broadcast on-air.

6. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Namibian courts.
